This case is about consumers who prepaid for gasoline on rental cars and were overcharged based on the defendant’s overstatement of the gas tank capacity, pursuing recovery for breach of contract and under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA).
class action members who rented a vehicle in the United States from Dollar Rent A Car or Thrifty Car Rental between December 19, 2009 and December 31, 2015, selected the prepaid fuel option, and paid a prepaid fuel charge that was based upon a fuel capacity listed in the rental vehicle profile that exceeded the actual fuel capacity of the vehicle.
