The class-action lawsuit, filed in 2017, alleged that Spectrum pharmacy violated the Telephone Consumer Protection Act (“TCPA”) by sending, via facsimile transmission, unsolicited advertisements that did not comply with the TCPA’s opt-out notice requirements. The Faxes promoted products sold, or services provided, by Spectrum pharmacy.
Class members that Spectrum or anyone acting on Spectrum’s behalf attempted to send facsimile transmissions that advertise, promote, or describe Spectrum’s products or services during the period from March 15, 2013 to October 25, 2018.
